Maintenance (formerly called alimony) is a support payment made from one spouse to the other pursuant to a divorce or legal separation. The Court may order the payment of maintenance when one spouse is not able to fully support themselves and the other spouse is able to contribute to the support of the spouse seeking maintenance.
There is no statutory percentage or specific formula to determine the amount of maintenance that will be awarded by the Court. The amount paid and the duration of the maintenance payments are determined by the Court based upon the factors set forth in the statute.
